The Fifth Circuit just upheld Texas’ ban on paid ballot harvesting — reversing a district judge who tried to block it before it even took effect.
The court held that states have broad authority to regulate elections and prevent fraud, and that Texas’ statute survives even strict scrutiny. The injunction was lawless, the facial challenge speculative, and the First Amendment claims failed. Election integrity measures can stand — even under the toughest constitutional test.
